Torture Destroys Childhood, Families, Society

With the Israeli Knesset's Public Petitions Committee (being held today)meeting on "Conditions of arrest and imprisonment of Palestinian youth in East Jerusalem and Judea and Samaria (sic)" PCATI reminds Knesset Members and their constituentsthat torture and ill treatment are absolutely prohibited and that Israel's legislature must anchor this prohibition in its domestic law.

The Istanbul Protocol Manual on the Effective Investigation and Documentation of Torture Raises the following issues regarding torture and children which must be understood:

"Perpetrators [of torture] often attempt to justify their acts of torture and ill-treatment by the need to gather information…One of the central aims of torture is to reduce an individual to a position of extreme helplessness and distress … Thus, torture is a means of attacking an individual’s fundamental modes of psychological and social functioning. The torturer attempts to destroy a victim’s sense of being grounded in a family and society as a human being with dreams, hopes and aspirations for the future. In addition, torture can profoundly damage intimate relationships between spouses, parents, children, other family members and relationships between the victims and their communities (Para. 235)… Torture can impact a child directly or indirectly. The impact can be due to the child’s having been tortured or detained, the torture of parents or close family members or witnessing torture and violence. When individuals in a child’s environment are tortured, the torture will inevitably have an impact on the child, albeit indirect, because torture affects the entire family and community of torture victims… Adolescence is a turbulent developmental period. The effects of torture can vary widely. Torture experiences may cause profound personality changes in adolescents resulting in antisocial behaviour. Alternatively, the effects of torture on adolescents may be similar to those seen in younger children (Para. 310 &312)."

Die israelische Menschenrechtsorganisation The Public Committee Against Torture in Israel (PCATI) hat der Regierung vorgeworfen, minderjährige Palästinenser zu foltern und zu misshandeln. Dazu legte die Organisation einen Bericht mit dem Titel »Kindheit ist keine Vergünstigung, sondern ein Recht« vor, in dem von Fällen, in denen Kinder in Außenkäfigen eingesperrt wurden, aber auch von Bedrohungen und Einschüchterungen sowie sexuellen Gewaltakten die Rede ist.



PCATI verurteilt ausdrücklich das Versäumnis Israels, die palästinensischen Minderjährigen vor den mutmaßlichen Folterungen und Misshandlungen zu schützen, und fordert die Behörden auf, besondere Bestimmungen zum Schutz der Kinder vor Folter in die israelischen Gesetze aufzunehmen.

Die Menschenrechtsorganisation erklärte, die israelischen Gesetze ließen das völkerrechtliche Verbot von Folter unberücksichtigt, wie es etwa im so genannten »Istanbuler Protokoll« beschrieben wurde, einem Handbuch zu erfolgreichen Ermittlungen und zur Dokumentation von Folter, das 2004 vom Büro des UN-Menschenrechts-Hochkommissars in Genf veröffentlicht wurde.

Das PCATI argumentiert, im Istanbuler Protokoll werde »Folter als ein Instrument beschrieben, um die grundsätzlichen psychologischen und sozialen Funktionen eines Menschen anzugreifen«. Darüber hinaus »kann Folter ein Kind direkt oder indirekt schädigen. Diese Schädigungen können aufgrund der am eigenen Leibe erfahrenen Folter oder Inhaftierung oder aber aufgrund der Folter der Eltern oder naher Familienangehöriger oder dadurch entstehen, dass das Kind Zeuge von Folter und Gewalt wurde«.

Der Bericht der Menschenrechtsgruppe wurde am 31. Dezember 2013 vor einer Anhörung des Öffentlichen Petitionsausschusses der Knesset zu damit zusammenhängenden Fragen veröffentlicht. Das PCATIstützt seinen Bericht auf Informationen aus Berichten von Misshandlungen von Kindern, die über den Zeitraum von zehn Jahren gesammelt worden waren. Die Praxis, Kinder in Außenkäfigen einzusperren, wurde aufgrund einer Intervention der Justizministerin Tzipi Livni abgeschafft, nachdem entsprechende Fälle ans Licht gekommen waren, berichtete die Jerusalem Post.

Das PCATI erklärte weiter, es untersuche selbst Fälle von Folter von Kindern und Misshandlungen durch Soldaten der israelischen Streitkräfte (IDF) und Vernehmungsbeamte. Dabei wird den Vorwürfen von Bedrohung und Einschüchterung sowie sexueller Gewalt, der Unterbringung von Gefangenen, darunter auch Kindern, in Eisenkäfigen, dem Verhalten der Militärangehörigen während Gefangennahme und Inhaftierung von Palästinensern nachgegangen. Die vom PCATI gesammelten Informationen werden von zahlreichen Nichtregierungsorganisationen (NGO) bestätigt, die ebenfalls mit der Dokumentation von Foltervorwürfen befasst sind.

Nach Angaben des israelischen Büros für Pflichtverteidiger (PDO) wurde die Unterbringung von Gefangenen in ungeschützten Außenkäfigen im Rahmen einer nächtlichen Inspektion eines Gefängnisses inmitten eines kürzlichen Schneesturms bekannt. Dabei wurden Kinder vorgefunden, die nach ihrer Verhaftung stundenlang bei eisigen Temperaturen unter freiem Himmel bis zu ihrer Vorführung vor einem Haftrichter am kommenden Morgen festgehalten wurden. »Während unseres Besuchs, der während eines heftigen Sturmes stattfand, der das ganze Land heimsuchte, trafen die Anwälte auf Gefangene, die ihnen schockierende Sachverhalte berichteten: Mitten in der Nacht wurden Dutzende von Gefangenen in Außenkäfige verlegt, die außerhalb des Übergangsgefängnisses in Ramla errichtet worden waren«, heißt es auf der PDO-Internetseite. »Es stellte sich heraus, dass diese Vorgehensweise, bei der Gefangene in Außenkäfigen festgehalten wurden, seit einigen Monaten praktiziert und von verschiedenen offiziellen Vertretern bestätigt wurde.«


Die Menschenrechtsorganisation PCATIhebt hervor, das »Versäumnis, dem verhafteten Kind oder Minderjährigen seine vollen, ihm zustehenden Rechte zu gewähren, darunter auch das Versäumnis, während der Inhaftierung und Befragung einen Rechtsbeistand oder die Begleitung durch einen Erwachsenen zuzulassen, setzen das Kind einem Zustand der Hilflosigkeit sowie einer seelischen und physischen Belastung aus, die durch die Sicherheitskräfte noch verstärkt wird, um während des Verhörs ein Geständnis oder Informationen herauszupressen«.

Die Messlatte, ab wann es sich um Misshandlungen und Missbräuche durch Israel handele, müsse, insbesondere gegenüber Kindern, niedriger werden. Die NGO ist überzeugt, Kinder undErwachsene gleichermaßen hätten ein Recht auf Rehabilitation. Die Menschenrechtsgruppe meinte weiter, bei Verdacht auf Misshandlungen und Missbrauch hätten die Betroffenen das Recht, auf einer vollständigen Aufklärung der Vorwürfe zu bestehen. Zudem stehe »ihnen bei einer Aussage vor einem israelischen Ermittler die Begleitung durch eine Person ihrer Wahl zu«.

Unter Bezug auf die Jahresberichte der Organisationen Zur Verteidigung der Kinder (DCI-Palästina) und Anwälte für palästinensische Menschenrechte (LPHR) bekräftigtePCATI: »Israel ist das einzige Land, das automatisch und systematisch Kinder vor Militärgerichten anklagt, denen es an grundlegenden Garantien für ein rechtsstaatliches Verfahren mangelt.«

Nach Schätzungen der Menschenrechtsorganisation landen jedes Jahr an die 700 Kinder, darunter zahlreiche Kinder im Alter von zwölf Jahren, in israelischen Militärgefängnissen und werden vor Militärgerichten angeklagt. »Der Mehrheit der inhaftierten palästinensischen Kinder wird das Werfen von Steinen zur Last gelegt, und 74 Prozent von ihnen erleben im Zusammenhang mit der Verhaftung, der Verbringung und den Verhören physische Gewalt«, wie aus Hinweisen hervorgehe, die von der Organisation DCI-Palästina gesammelt wurden. »Kein israelisches Kind bekommt es jemals mit dem Militärgerichtssystem zu tun.«

GENEVA (AFP) -- A pro-Israel group said Sunday that it, with backing from Washington, would call on the UN's top rights body to dismiss a top official after he demanded an investigation of the organisation.

"UN Watch's draft resolution to remove (Richard) Falk has been published by the United Nations as an official document and will be put before the (Human Rights) Council when he addresses it tomorrow," the group said in a statement.

US ambassador to the Human Rights Council Eileen Chamberlain Donahoe also called for Falk's departure in a statement Friday.

The calls came after the outspoken expert on the rights situation in the Palestinian territories published a report in which he urged the council to investigate UN Watch, which he described as "a pro-Israel lobbying organisation accredited as an NGO."

The group has repeatedly attacked Falk in the past for alleged anti-Israel bias, and launched a recent campaign to highlight comments he had made that could be interpreted as justification of the Boston marathon bombing.

In his report, which he is set to present to the rights council in Geneva early Monday, Falk accused UN Watch of launching "a smear campaign" against him, charging it "has issued a series of defamatory attacks demeaning his character, repeatedly distorting his views on potentially inflammatory issues."

He called on the 47-member rights body to investigate UN Watch "to determine whether it qualifies as an independent organisation that operations ... and is not indirectly sponsored by the government of Israel."

UN Watch chief Hillel Neuer hit back, calling on "UN Secretary Ban Ki-moon to denounce Richard Falk's McCarthy-style attempt to have rogue regimes conduct a retaliatory 'investigation' of UN Watch, as a punishment for successfully exposing his gross misconduct."

Donahoe supported the group in her statement Friday, stressing that "the United States completely rejects and condemns the irresponsible call ... to investigate a legitimate and UN-accredited NGO."

"Mr. Falk's most recent statement, which he dramatically and recklessly included in an official UN document, ... once again starkly demonstrated that he is unfit to serve in his role as a UN special rapporteur," she said, adding: "We once again call for his resignation."

Falk, a Princeton University international law professor who has labelled Israel's 2008 offensive against Gaza as "war crimes", also met harsh US and Israeli criticism after he last year urged a boycott of companies helping Israel's settlement expansion in the Palestinian territories.

The report he is set to present Monday takes Israel to task for a long line of alleged abuses, many linked to its "illegal blockade of Gaza," an area likened to "a large open-air prison in which the inmates control the interior while the guards control the perimeter."

Israeli veterans have spoken out, describing a degrading culture of abuse and harassment of Palestinian children in the West Bank and Gaza. A report containing 30 veterans’ testimonies details numerous cases of violence committed by Israeli soldiers.

The report was released to world media on Saturday byBreaking the Silence, an organization made up of Israeli army veterans formed in 2004. They compiled more than 850 accounts from current and former Israeli soldiers describing abuses they committed or witnessed. [1]

The investigation seeks to serve as “a witness to the ongoing decline of the military system into increasing immorality."

“The words of the soldiers included here constitute an urgent call to Israeli society and its leaders: We must foster a serious discourse regarding the price of military rule of the Occupied Territories,” said the report.

A number of reports pertain to the detention and abuse of minors who pelt Israeli soldiers with stones and the imposition of Israeli control in occupied areas.

A first sergeant in an armored corps unit described his job as “population control,” in a testimony entitled "What is that job, really?" His unit would enter Palestinian villages on a daily basis to “make their presence felt” and to show the local residents that the area did not belong to them.

“A patrol goes in, or two patrols, two Hummers secured by a jeep, and raise hell inside the villages. A whole company may be sent in on foot in two lines like a military parade in the streets, provoking riots, provoking children,” said the first sergeant.

He said that his commander’s aim was to “grind the population down” so that they would not even think of throwing stones at their occupiers.

‘Whoever is slow to run gets beaten up’

One testimony describes in detail a camouflaged ambush on Palestinian children in Qalandiya in the West Bank following a riot. The platoon cornered the children and beat them with wooden clubs as they tried to escape.

“People were made to fall to the ground, and then the soldiers with the clubs would go over to them and beat them. A slow runner was beaten, that was the rule,” said a first sergeant in the Engineering Corps. According to the sergeant such ambushes were carried out about four or five times sometimes on the same children. The aim of the exercise, the sergeant said, was to discourage the children from throwing stones at the Israeli soldiers, but he did not believe it had any effect.

‘Not considered kids’

The report documents numerous cases of children under the age of 16 being taken into custody, blindfolded and deprived of food and water. A first sergeant from a Paratroopers Brigade who regularly took children of 12-14 years of age into custody for attempting to cross the border into Israel said they were taught to treat the children not as small children, but as assisting terrorists.

“The intelligence officer saw two soldiers beating one of the detainees. I think they were about 16 years old, if I remember correctly,” he said.

‘We’d lost all sense of mercy’

Another veteran described how his troop would trash shops and buildings because they were bored, purposely triggering riots. He related an incident where Israeli soldiers waiting for civilians outside a mosque began to fire rubber rounds in order to spark a riot. He said that if Arab children threw stones at them they would use them as human shields.

“You know how badly beaten they get? You catch him, push the gun against his body, he can’t make a move, he’s totally petrified. He only goes: "No, no, army." You can tell he’s petrified.”

Report slanders IDF

In response to the report the Israeli Defense Forces (IDF) said that Breaking the Silence had revealed its true intentions “to generate negative publicity regarding the IDF and its soldiers, rather than facilitating a proper investigation."

"As a matter of policy, the organization chooses not to provide the IDF and other relevant bodies with the critical material necessary for investigation. By compiling testimonies over long periods of time and refusing to provide additional detail, [Breaking the Silence] proves its true intentions – rather than facilitating proper investigation, the organization seeks to generate negative publicity regarding the IDF and its soldiers.” the IDF toldThe Weekend Australian . Breaking the Silence member Yehuda Shaul hit back at the IDF, saying "over 70 of our testifiers have come out publicly with their names and identities revealed, and I’m one of them."

“If the IDF was interested in investigating our claims, we probably would have already been summoned to interrogations," concluded Shaul.

El joven D. ha pasado como la mayoría de los israelíes tres años en el Ejército. A diferencia del resto, llegó un momento en el que decidió desertar porque no le gustaba lo que veía ni lo que se veía obligado hacer. Pasó por la cárcel y ahora se plantea dejar por escrito las experiencias que le marcaron como soldado y que no se puede quitar de la cabeza. Puede que las que más le ronden sean las de los niños. Las de los soldados que pegan y abusan de los niños, a menudo víctimas de los excesos del Ejército de ocupación. Su experiencia y la de otros soldados que han decidido hablar, las publica Breaking the silence, la organización israelí que aspira a romper el silencio que rodea a los crímenes y excesos que cometen los jóvenes soldados en un país en el que la mili es obligatoria y que se siente en guerra permanente.

D. pone ahora palabras a sus traumas sentado en una cafetería de Jerusalén. “Entramos en un pueblo. Tomamos la escuela y detuvimos a todos los hombres de entre 14 y 50 años porque nos habían dicho que gente del pueblo había tirado piedras. Eran las tres de la mañana. Los soldados llegaban con decenas de detenidos, esposados y con los ojos vendados. Uno detrás de otro. Formaban un tren. Estaban aterrorizados. Unos lloraban. Otros se hacían pis. Los soldados les zarandeaban y les tiraban de las orejas. Luego les sentaron durante horas y les interrogaron. Las esposas de plástico les cortaba la circulación”. Y prosigue: “Me tocó escoltar con otro soldado a un detenido de unos 14 años al baño. El oficial miró para atrás y al ver que no había testigos le dio un puñetazo al chico y lo tiro al suelo, que estaba lleno de mierda”. D. decidió que no quería participar nunca más en incidentes de ese tipo y desertó antes de que le recolocaran en una base como paramédico.

Los testimonios de los soldados hablan de un esquema de conducta rutinario en el que no diferencian entre mayores y menores de edad y en el que a los varones palestinos se les trata como un bloque homogéneo y peligroso. Las escenas que relatan los soldados se parecen mucho entre ellas: los militares entran en un pueblo palestino en el que ha habido manifestaciones o desde donde los jóvenes han tirado piedras y efectúan detenciones masivas. Maniatan a los detenidos y les vendan los ojos. Les dejan durante horas sentados en el suelo, muertos de miedo. Es durante esas horas cuando se producen las amenazas de muerte, las palizas y las humillaciones a los supuestos sospechosos. O una patrulla entra en un pueblo palestino, los niños tiran piedras contra los militares y acaban detenidos como los mayores. O niños a los que se utiliza como escudos humanos para entrar en casas y efectuar detenciones.

Algunas de las historias de los soldados revelan incidentes graves, que explican son posibles porque sienten que operan en un clima de impunidad; que hagan lo que hagan es muy poco probable que acaben en la cárcel por maltratar a un menor. “Nuestra misión es cazar a los malos. Lo demás son daños colaterales”, explica Amer, un joven sargento, que ha pasado a la reserva. “La consigna es que todos son culpables hasta que no se demuestre lo contrario. Por eso entramos en las casas por la fuerza bruta, como si todos los palestinos fueran suicidas. Por eso y porque el Ejército aplica un apolítica de riesgo cero. Gerard Horton, de Defence for Children International, organización dedicada a velar por los derechos de los menores en los territorios ocupados palestinos, habla de varios tipos de abusos a menores palestinos y pide “que se les trate igual que a los niños israelíes”. Para Horton, como para muchos observadores, uno de los grandes problemas es “la propia existencia de un Ejército de ocupación durante 45 años. Claro que no están entrenados para detener a niños, porque la idea de un Ejército no es que se dedique a controlar a una población durante décadas”.

“Entramos en los pueblos [palestinos] todos los días por lo menos dos o tres veces para hacer sentir nuestra presencia es como si les ocupáramos. Me acuerdo sobre todo de los adolescentes. Una vez detuvimos a tres chicos; eran parte de una banda que no paraba de tirarnos piedras y eran sólo niños. A veces usamos botes de humo. En un momento dado, el oficial disparó a los piernas, pero desde una distancia muy corta. No sé por qué. Desde unos 20 metros, algo así. En el momento que lo hacía, un niño se estaba agachando para recoger una piedra y le dispararon en la cabeza. A partir de ahí, el incidente se agravó, vinieron los paramédicos, una ambulancia judía, una árabe. No me acuerdo exactamente. Después un rato largo, porque la situación era peligrosa y la mitad de su cerebro estaba fuera del cráneo. Al final llegó al hospital y creo que dos días después murió. Mirando los hechos, se podría pensar que fue una muerte inintencionada. Pero yo conozco al ese oficial y aquello fue intencionado.

Siempre esos llantos. Están esos momentos tan molestos cuando estás en una misión de detención y no hay sitio en la comisaría y te tienes que llevar al niño de vuelta contigo al puesto militar, vendarle los ojos, ponerle en una habitación y esperar a que la policía venga a recogerlo a la mañana siguiente. Se queda allí sentado como un perro…

• “Disparó porque es el que manda”. Sargento primero, Nablús 2006-2007.

Son críos. Hay muchas posibilidades de que yo hiciera lo mismo si estuviera en su lugar. Hubo un caso de un comandante que decidió disparar a uno en la pierna porque él es el que manda. Balas de verdad.

• “Tratan de entrar en Israel porque sus familias pasan hambre”. Sargento, Franja de Gaza. 2008.

En Nahal Oz, los niños intentan venir para encontrar comida o algo. Los padres deben enviarles para intentar entrar en Israel porque sus familias pasan hambre. Creo que los niños tenían 14 o 15 años. Me acuerdo de un niño, que estaba ahí sentado, con los ojos vendados y vino un soldado del que se sabía que era un idiota, le golpeó y le echó grasa del rifle por encima.

• “Le lanzó una granada de sonido y el niño salió corriendo”. Sargento, Ramala 2009.

Nos había llegado el mensaje de que alguien había tocado la valla. […] Allí había tres niños, el mayor de ellos de 15 y uno pequeño de siete u ocho y otro que debía estar entre medias. El comandante los detuvo y quiso hacer unas comprobaciones, así que los sentó al borde de la carretera a cinco metros de distancia cada uno. […] Abrió las puertas traseras del jeep y metió al niño [el más pequeño]. No le pegó pero le amenazó brutalmente y el niño empezó a llorar. Cuando obtuvo al información que quería, detuvo a los otros dos niños y el pequeño volvió al pueblo. Le gritó “vete, vete al pueblo”. El niño estaba aterrado. El comandante lanzó una granada de sonido y el niño salió corriendo.

Hicimos una incursión en una casa abandonada, después de que hubiera habido choques en Calandia un viernes. Los soldados salieron con bates y empezaron a dar palizas hasta que dejaron a la gente hecha papilla. A los niños que quedaban por allí los detuvieron. Hacían corree a la gente. A los que se quedaban rezagados, les pegaban con los bates. A los que estaban en el suelo, también. [Mi unidad hizo esto] varias veces. Por lo menos cuatro o cinco. Con niños deferentes probablemente… […] para que aprendieran la lección. Sólo espero que los niños que acaban detenidos en la base militar o en la comisaría no vuelvan a tirar piedras, pero me temo que ese no es el resultado.

Humanizar a los soldados

Mohamad, el mayor de los hermanos, lleva de la mano al pequeño de visita a los chepckpoints israelíes. Salen de su pueblo, a las afueras de la ciudad palestina de Hebrón, al encuentro de los soldados para hablar con ellos. Esta actividad tan atípica forma parte de los deberes que les ha puesto la psicóloga para superar las secuelas de la operación militar que presenció en su propia casa. “Los soldados atacaron nuestra casa durante varios días con los niños dentro. Estaban aterrorizados”, explica la madre de familia en la planta baja de la casa. Dos de los hijos entraron en shock durante la incursión. Una de las hijas perdió el conocimiento debido a un exceso de inhalación de gas lacrimógeno. La pequeña todavía tiene convulsiones. El pequeño se fue aislando poco a poco.

El aislamiento y la agresividad son dos de los síntomas más típicos, según los especialistas del equipo de Médicos sin Fronteras en Hebrón. Concentran sus esfuerzos en terapias de corta duración, principalmente de enfoque cognitivo conductual, con las que tratan de borrar algunos de los traumas infantiles. La terapia de exposición a los soldados que practica Mohamad con su hermano forma parte del programa en el que participan niños y adultos. Humanizar a los soldados, ponerles cara y voz, les está ayudando mucho dice el mayor de la familia.
